1) GENERAL PROVISIONS

These General Terms and Conditions of Online Purchasing (hereinafter referred to as the “General Terms and Conditions”) define the terms of use of the website www.jeordiesmen.com (hereinafter referred to as the “Website”) and the realization of purchasing products online or ordering, payment delivery, complaints, etc. If you want to use the benefits of online purchase of our products, we invite you to familiarize yourself with the General Terms and Conditions, and in case of questions, you can contact us using the contact form on the website. Use of the website and processing of your online order inevitably involves the processing of your personal data, so please read our Privacy Policy.

Online sales through this website are performed by the seller KUBAK STIL d.o.o. from Zagreb, Samoborska Cesta 145 E, OIB 27731477687 (hereinafter referred to as the “Seller”), entered in the court register of the Commercial Court in Zagreb, MBS 030124319, represented by the director Ali Hakan Kubak.

A customer is any person over the age of 18 who registers through the website and orders one or more products, and by registering confirms that he is an adult and legally capable person (hereinafter "Customer").

By ordering our products, you confirm that you are familiar with our General Terms and Conditions and that you agree to them, and they form an integral part of the contract of sale concluded between the Seller and the Buyer.

 

2) REALIZATION OF ONLINE PURCHASE

 

Registration

If you want to order our products/goods through the website, you must first carry out the registration process on the website. Please note that the Buyer is responsible for the accuracy and completeness of the data when registering and/or ordering products.

Therefore, if there is a change in your data that you entered in the registration process, please update them. When registering, you are required to create a password, and we suggest that you do not share it with others, as you are responsible for all orders under your account. If there is a reasonable suspicion of misuse of the account or rights, the Seller has the right to block your account.

 

Ordering

The ability to order certain goods through a website depends on its availability. The order can be executed 24 hours a day, 7 days a week. Please note that you choose our products based on photos that are illustrative in nature and do not have to match the product in every detail.

To complete the order, you must follow the procedure and add the selected products to your cart, and you can change your order until the payment is confirmed. After confirming the payment, we will notify you by email that the order has been received. If you have not received the notification in question and you are convinced that you have placed your order, please contact us via the contact form. If due to certain extraordinary circumstances we are not able to process your order, we will notify you without delay and reserve the right to cancel the order.

Payment

Prices on our website are expressed in HRK with the corresponding value-added tax, and the prices and benefits that are in force on the day of receipt of the order are valid. We emphasize that prices, payment terms, and special offers may change at any time, however, such change does not affect your orders placed before the change. In the event that we discover an error in the product label, price, etc., we reserve the right to cancel the order, and the entire amount charged will be refunded.

Payment is made by cash on delivery or by credit and/or debit card. We guarantee the security of your data as it is encrypted. By confirming the payment, you confirm that the card is yours.

After receiving the order, we ask for authorization that the transaction is possible, and the funds are charged just before the goods are shipped. In the event that it is not possible to carry out the transaction, the goods will not be delivered to you and we believe that you are not able to enter into a contract. After processing the order and receiving the payment, you will receive an email that the goods have been shipped.

 

3) DELIVERY

The ordered goods are delivered via the GLS delivery service to the address you specified during registration or registration.

For Croatia; Delivery is free for orders worth more than HRK 299.00, and for other orders, delivery is charged in the amount of HRK 20, which amount is indicated on the invoice.

For the Czech Republic, Slovenia, Austria, Hungary; Delivery is free for orders worth more than 50€, and for other orders, delivery is charged in the amount of 5€, which amount is indicated on the invoice.

 

We will deliver the ordered goods to you within 7 working days from the day of the order together with the original invoice, and if the delivery is made to the islands, the delivery time is longer by 3 working days. In the event of unforeseen circumstances beyond our control, there may be a delay in delivery. If delivery is delayed for more than 30 days, you have the right to cancel your order via the contact form.

The goods are considered delivered at the time of receipt of the shipment, which is confirmed by the signing of the receipt by the person who received the shipment at the delivery address.

On the day of delivery, you will be notified by SMS about the delivery time of the shipment. If you cannot pick up the shipment at the time of delivery, please let us know so that delivery can be arranged for another day.

In the event that the shipment cannot be delivered to the delivery address for reasons for which the Seller is not responsible, we will inform you how you can pick it up. The deadline for collection of the shipment is 30 days from the date of notification on how you can pick it up, after which period we will consider that you have withdrawn from the contract and refund the funds collected, provided that the Seller reserves the right to charge shipping, handling and other possible costs.

4) UNILATERAL TERMINATION OF THE CONTRACT

 

As a Consumer, you have the right to unilaterally terminate the contract for a period of 14 days without giving a reason, and which period begins to run from the day when you or a third party on your behalf received the goods you ordered.

In order to exercise the right to unilateral termination of the contract, you must notify the Seller KUBAK STIL d.o.o. from Zagreb, Samoborska Cesta 145 E, on unilateral termination of the contract before the expiration of the specified period through this Form for unilateral termination of the contract or by a statement expressing the will to terminate the contract, stating name, address, telephone number, fax number, and e-mail address mail and the contract/order that you terminate as a consumer. You can send us the statement or form in question via the contact form on the website or by mail to the Seller's address. We will send you an acknowledgment of receipt of the notice of unilateral termination of the contract by e-mail without delay.

In case of unilateral termination of the contract, you bear the costs of returning the goods and you must return it to the above address to the Seller undamaged with the appropriate label, through the postal service provider, together with the invoice, no later than 14 days from the date of unilateral termination.

We emphasize that it is not possible to return goods that are not suitable for return because they are closed and lose quality when opened or when it comes to goods that are tailored to the individual customer or made at his request by certain measures.

We will refund without delay within 14 days of receiving notice of unilateral termination, but not before the goods are returned. Refunds are made to the card that was charged at the time of payment, and if the goods are paid on delivery, please contact us via the contact form about the method of return.

The buyer, as a consumer, is responsible for any impairment of the goods resulting from the handling of the goods other than that which was necessary to determine the nature, characteristics, and functionality of the goods. If the goods are damaged in such a way that they are not able to be resold for reasons that are not on the side of the Seller, he is not obliged to accept such return of goods and refund the amount paid to the Buyer. registration on the website.

 

5) COMPLAINTS AND REPLACEMENT OF GOODS

In case the received goods do not correspond to the description of your order or are damaged, please contact us via the contact form. In relation to the return of goods, the conditions from Article 4 apply, and upon receipt and inspection of the goods, we will inform you about the possibilities of replacing the goods or the right to a refund of the amount paid. If the goods have material defects, we will deliver another product without a defect or refund the funds collected, of your choice.

In case the received goods are not suitable for you due to the size or model, but you would like to replace them with other goods, please contact us via the contact form. Please note that, in the event of a complaint and/or replacement of goods, you must return the item in question together with the corresponding label and invoice.

6) COMMUNICATION

Notices and communication between the parties will be made in writing via email and contact form on this website. By registering on the website and sending the order, you agree that all mutual communication is done in the manner described.

7) PARTIAL INVALIDITY

If any provision of these General Terms and Conditions is found to be null and void, the other terms and conditions remain in force and the Seller will replace the null and void provision with effect without delay.

8) JURISDICTION AND APPLICABLE LAW

Croatian law applies to the use of this website as well as to contracts concluded on the basis of online orders, and in the event of a dispute, the court in Zagreb has jurisdiction.

9) COMPLAINTS

In case you are dissatisfied with our service, you can send us a complaint via the contact form on this website. Your opinion is important to us, and customer satisfaction comes first. Please indicate in the complaint the order you are complaining about and your user data, and we will send you a response within 15 days of receiving the complaint.

 

10) APPLICATION OF GENERAL CONDITIONS
